SCOPE AND NATURE OF SERVICE
1.1. Nature of Service: Ignis Vault is a digital management and continuity platform. It provides users with a secure environment to inventory, organize, and manage information regarding their global assets, documents, and final wishes. Ignis Vault acts strictly as a digital custodian and informational hub.
1.2. Nature of Information: Ignis Vault provides digital tools for the manual organization of assets. Any checklists or templates provided are static informational tools. Ignis Vault does not currently provide automated legal advice, nor does it use automated decision-making or AI-driven legal interpretation.
1.3. Future Feature Reservation: Ignis Vault reserves the right to introduce automated processing, OCR, or AI-assisted organization in the future. Users will be notified of such updates in accordance with our "Changes to Terms" section.
SUCCESSION PROTOCOL & SIGNATORY RIGHTS
2.1. Eligibility: Only individuals pre-nominated by the Account Holder and listed in the "Succession Plan" may initiate the verification process.
2.2. Data Release: Upon manual verification of a Death Certificate, designated Signatories gain View-Only Access to filtered segments (Patrimony and Death Wishes).
2.3. Export & Liability: Signatories are permitted to download/export authorized files. Once exported, Ignis Vault assumes no liability for the subsequent use, storage, or disclosure of said data.
2.4. Conflicting Claims: In the event of disputes between multiple nominated Signatories or legal heirs, Ignis Vault reserves the right to freeze the account upon receipt of a formal legal notice from a competent court.
DATA SECURITY & ENCRYPTION
3.1. Zero-Knowledge: Ignis Vault does not store decryption keys. While we facilitate account recovery via Biometrics/MFA, we cannot decrypt files if the encryption parameters are lost due to User negligence.
3.2. Data Integrity: The service is provided "as-is." Ignis Vault is not liable for data corruption or loss arising from technical failure or cyber-attacks.
ACCOUNT TIERS, RETENTION & TERMINATION
4.1. Active User Accounts (Living Users):
Free Accounts: Users may maintain a free account with restricted storage capacity and limited access to premium features. Free accounts that remain inactive (no login) for more than 6 consecutive months are subject to permanent deletion following a 30-day email warning.
Paid (Premium) Accounts: Access is based on an annual subscription.
Grace Period: If a subscription is not renewed, the account enters a 30-day Grace Period.
Downgrade: After the Grace Period, the account is automatically downgraded to the Free Tier. If the stored data exceeds the Free Tier’s capacity, the User will have 3 months to either renew the subscription or download excess data. After this period, data exceeding the limit will be purged, starting with the oldest files.
4.2. Legacy Accounts (Post-Mortem):
Signatory Access: Once a Death Certificate is verified, the account (whether previously Free or Paid) is transitioned to Legacy Status.
Closure Period: Ignis Vault provides a 12-month complimentary archiving period for the "Patrimony" and "Final Wishes" segments to allow Signatories to settle the estate.
Final Deletion: Upon the expiration of the 12-month Closure Period, all data associated with the account is permanently deleted.
JURISDICTION & CHOICE OF LAW
5.1. Applicable Law: These Terms are governed exclusively by Portuguese Law.
5.2. Forum (B2B): For Partners and business entities, the Comarca de Lisboa is the exclusive jurisdiction.
5.3. Forum & Jurisdiction (B2C): For individual consumers resident in the European Union, any dispute may be brought, at the consumer's discretion, either before the courts of Portugal or the courts of the Member State in which the consumer is domiciled. Notwithstanding the choice of forum, all disputes shall be governed and interpreted exclusively in accordance with Portuguese Substantive Law, to the extent permitted by the mandatory consumer protection laws of the consumer's residence.
